Sworn Testimony — Affidavit

“The NIEHS directly controlled and approved the information provided to the Study participants and their families as well as the information contained in the Informed Consent forms.” — Affidavit of Cecilia Davoli, M.D., in support of notice of removal, Featherstone v. Kennedy Krieger Institute, Document 1-2 (May 1, 2007)

The federal court rejected this characterization. Judge William M. Nickerson wrote that NIEHS's control was designed to ensure procedural uniformity across a multi-center trial, not to further any federal policy.

Deposition Excerpts

From Davoli deposition in Coles v. KKI, November 21, 2003 (submitted as exhibits in Featherstone):

“Within the context of the TLC study we were providing some care for the child, but I wouldn’t describe it as primary treatment of the child.” “She was participating in a study.” — Davoli depo pp. 166–169 (Featherstone Document 28-39, Exhibit 35)
On the consent form language promising “we will look carefully at your home,” Davoli conceded “we” meant “someone in the environmental arm of the TLC study, yes, who was employed by Kennedy Krieger.” She acknowledged sitting through “more than 20” consent form signings, “possibly” more than 100. — Davoli depo pp. 174–177 (Featherstone Document 28-40, Exhibit 36)
“We would draw the blood, that is correct. We, Kennedy Krieger, will draw the blood.” — Davoli depo pp. 198–201 (Featherstone Document 28-42, Exhibit 38)
